1) Photographer owns the copyright, regardless of whose equipment is used. 2) Real photographer will want to use his/her own gear anyway as it is likely better than yours. 3) In NSW digital images are considered published as soon as they are shot, blurring the line between consent & publication. If you consent to it being recorded digitally you have consented to it being published, anywhere. To protect your rights, Insist on using analogue equipment, super8 is good. Have fun but stay safe, revenge porn is not cool, extortion is worse!

Hi Ladylover, I see the importance of being careful, but just to add a different view point - my 2 cents as someone in the industry. This is just my experience, I'm not a lawyer... 1. I get hired for jobs on a semi-regular basis where I get the job under terms that the client retains the right to use the content exclusively - I may own the copyright, but part of the agreement for me getting the job is that I'm not allowed to publish the content anywhere. If I don't like that, I don't get the job - and I have no problem with that, it's professional courtesy. If I publish it, I'm in breach of contract and open to be sued, let alone the fact my reputation is screwed and in my industry reputation is huge. Furthermore, it's even less of an issue for them if they're using their own equipment - whilst I may own the copyright, how would I prove that I pressed the record button? Too much hassle for me to chase up over a private erotic video. The main thing that concerns me with copyright is if I create content and someone uses it for their own financial gain without me agreeing to it (if I've agreed to it, then I don't care). If everyone sticks to the agreement upfront then there's never an issue. 2. Maybe, but plenty of instances where I've used equipment not my own - I have no problem using other peoples equipment, it's just about knowing the limitations of it and working out the client's expectations, once again comes down to the pre-agreement with the client, if using their equipment is a condition and I don't like it, I don't get the job. Almost all levels of equipment these days can produce amazing results if used in conditions that suit it's sweet spot. My gear is usually just about saving time as it's familiar to me. 3. Happy for you to show me where the definition is for this, I've never understood the law to mean this at all. My experience once again is in the contract for hire, or pre-agreement. If they say you get the job on the basis you can't publish the content, you can't. Furthermore, my understanding with NSW revenge porn laws, the onus is on the person who put it out there to prove they had consent to publish it - not on the person(s) depicted in the content to prove the videographer didn't have the right. I for one have no desire to go to jail and experience lack of consent first hand... :) Katy/Greg - my advice is that whatever path you go by, meet them in person and go with someone you feel comfortable with. If they're normal, honorable people they should be comfortable doing it under your terms and using your equipment. I've been at events where the couple has "captured the moment" themselves via pics or videos, typically avoiding faces, however at one time one of them used a dedicated videographer completely not part of the play. I agree with others that a professional would have their own gear. If you want an amateur type focus, you could always set up multiple mini cams around you, and/or combine that with some roving recording. - Posted from rhpmobile

Not sure if you intend editing the photos yourself, but would expect that who ever takes the photos will be able to enhance them and/protect your identity by editing them in Lightroom or Photoshop. - Posted from rhpmobile

We have no interest in keeping any material and happy to hand everything over that night and delete.
